Last Updated: August 27, 2026
1. Acceptance of Terms
These Terms of Service govern your access and use of Metasteps.com (the "Site"), and the related services provided by Metasteps (collectively, the "Services"). Your access and use of the Services is expressly conditioned upon your acceptance of and compliance with these Terms of Service as well as to Metasteps' Privacy Notice which is incorporated herein by reference. If you do not understand or consent to these Terms of Service, you may not access or use the Services. If you access or use the Services on behalf of a company, organization or other legal entity, you represent and warrant that you are authorized to bind such entity to these Terms of Service.
These Terms of Service, together with the Data Processing Addendum and the Professional Services Addendum (as applicable) constitute a binding agreement between you and Metasteps.
By accessing or otherwise using the Metasteps Services, you acknowledge and agree that:
- you have read, understand, and agree to be legally bound and to comply with these Terms of Service,
- you have the right, authority and legal capacity to enter into this agreement and to comply with these Terms of Service, and
- if you are acting on behalf of a company, organization or other entity, you are authorized to bind such entity to this agreement.
2. Modifications of Terms
Metasteps may update or modify these Terms of Service from time to time. Where changes are material, Metasteps will make reasonable efforts to notify you for example by posting a notice on the Services or by other appropriate means. The date of the most recent update will be indicated by the "Last Updated" heading at the top of this page. Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the revised Terms, to the extent permitted by applicable law.
3. Youth Restrictions and Parental Control
By accessing or using the Services, you represent and warrant that you are at least eighteen (18) years of age or have reached the applicable digital age of consent in your country of residence, and have obtained the consent of a parent or legal guardian, and that you are legally able to enter into and comply with these Terms of Service. Individuals under the authorized age in their country of residence (each, a "Minor") are not permitted to register for or create an account with Metasteps. The applicable digital age of consent varies by country of residence and generally ranges from thirteen (13) to sixteen (16) years of age. The Services are intended for a general audience and are not specifically directed toward children or minors. Metasteps does not knowingly collect personal data from Minors who are not legally permitted to use the Services. If you are a parent or legal guardian and believe that a Minor has created an account with Metasteps without your consent and in violation of these Terms of Service, please contact the Metasteps support team at [email protected] to request account deletion. Metasteps may request information reasonably necessary to verify your identity and parental or guardianship status. Any such information will be used solely for the purpose of processing and verifying the request.
4. License
The Services and all images, software, platforms, tools, graphics, data, text, code, the Metasteps and other content and materials made available through the Services (excluding User Content) including the selection and arrangement thereof (collectively, the "Metasteps Property") are the property of Metasteps or its third party licensors and are protected by national and international intellectual property laws. Subject to your compliance with these Terms of Service, Metasteps grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Metasteps Property solely for your permitted use of the Services in accordance with these Terms. Except for the limited license expressly granted herein, Metasteps reserves all rights, title, and interests in and to the Metasteps Property and no additional rights are granted by implication or otherwise. You acknowledge that: (a) all right, title and interest in and to the Metasteps Property, including all patents, copyrights, trade secrets, trademarks and other proprietary rights embodied therein or associated therewith, are and shall remain the exclusive property of Metasteps or its third party licensors; (b) no ownership rights or other interests in the Metasteps Property are transferred to you under these Terms.
By creating an account or using the Services, you grant Metasteps a limited, worldwide, royalty-free, non-exclusive, non-transferable license to use your company or organization name, logo, and trademarks ("Customer Marks") solely for promotional purposes, including but not limited to:
- Listing you as a customer on metasteps.com (e.g., "Our Customers" page)
- Referencing your use of Metasteps in marketing materials, case studies, press releases, social media, and website testimonials
Metasteps will use Customer Marks in accordance with your publicly available brand guidelines (if provided) and industry standards. Metasteps will not materially alter your logo or use it in any manner that disparages your brand. This license may terminate upon account deletion, though we may retain archived copies for legal/compliance purposes. To revoke this license, email [email protected]. We will cease use within 90 days, subject to completion of ongoing campaigns.
5. Restrictions
You agree not to and not to permit any third party to:
- modify, alter, copy or create derivative works of the Metasteps Property,
- decompile, disassemble, reverse engineer, translate or otherwise attempt to derive the source code, structure, algorithms or underlying ideas of the Metasteps Property
- bypass, disable or interfere with any security, access control, or copy-protection mechanisms used by the Services or the Metasteps Property.
Except as expressly permitted under these Terms, you may not use the Services or the Metasteps Property to:
- collect, copy, distribute, publicly display, or publicly perform any portion of the Metasteps Property,
- resell, sublicense, commercially exploit, or otherwise make unauthorized commercial use of the Services or the Metasteps Property,
- scrape, crawl, or use automated means (including bots, robots, or data-mining tools) to access or extract data from the Services,
- frame, mirror, or embed the Services or Metasteps Property, except through functionality expressly provided by Metasteps (such as authorized embeddable viewers);
- download or store any portion of the Metasteps Property, except where expressly permitted or where the content consists of User Content made publicly available by its owner; or
- use the Services or the Metasteps Property for any purpose other than their intended and permitted use.
Unless expressly authorized in writing by Metasteps, you may not use the Services primarily for commercial exploitation of the Metasteps platform or content, including:
- using the Services principally to generate advertising revenue or subscription income unrelated to your own User Content;
- using the Services in a manner that competes with or displaces Metasteps or its core offerings; or
- selling advertising, placed on or targeted to Metasteps content without authorization.
The following are not prohibited commercial uses:
- uploading and displaying your own original User Content to promote your business, artistic work or educational activities; or
- any other use expressly authorized by Metasteps in writing.
Any use of the Services or the Metasteps Property not expressly permitted under these Terms constitutes a material breach and may result in suspension or termination of your access to the Services, in accordance with these Terms and applicable law.
6. Your Account
Certain activities on the Services require you to register and create an account. You may not use another person's account without permission. When creating an account, you must provide accurate, current and complete information ("Registration Data"). You agree that Metasteps reserves the right to refuse, change, remove or replace user names at its sole discretion, including but not limited to cases where a user name impersonates another person, is offensive or violates third party intellectual property rights. Please note that your user name may be publicly visible.
Metasteps reserves the right to terminate your account and/or deny access to the Services at any time, with or without cause, at its sole discretion. If Metasteps terminates your account due to inactivity, Metasteps will make reasonable efforts to notify you in advance by email using the email address associated with your account. You agree to keep your registered email address accurate and up to date, as Metasteps may send important notices about your account from time to time. By registering for an account, you consent to receive communications from Metasteps regarding the Services via email and/or system messages in accordance with our Privacy Policy.
Account Security
To register on the Site you are required to choose a password. You are solely responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You may not share, transfer, or allow others to use your account, user name, or password, nor may you lend or otherwise transfer your access to the Services to any third party. You agree to log out of your account at the end of each session and to take reasonable steps to prevent unauthorized access to your account. Metasteps is not liable for any loss or damage arising from your failure to comply with these obligations.
User Content that you post, upload or otherwise make available through the Services may be accessed, used and downloaded by other users of the Services. You acknowledge and agree that any User Content made available in public areas of the Services, is publicly accessible and may be accessed, viewed, downloaded, indexed, archived, linked to or republished by others, including, without limitation, appearing on third-party websites and in search engine results. Metasteps uses commercially reasonable security measures to protect User Content in accordance with your Account Settings. However, Metasteps cannot guarantee absolute security of your account, User Content, or Registration Data, and does not warrant that its security measures will prevent unauthorized access, hacking, or other security breaches. Metasteps is not responsible or liable for any unauthorized third-party access to or use of your User Content or Registration Data. You agree to notify Metasteps immediately of any unauthorized use of your account, password or any other breach of security, and you accept all risks associated with unauthorized access to your Registration Data, User Content and any other information you provide to Metasteps.
7. User Content
As a Metasteps account holder you may submit assets, create rooms and exhibitions and submit textual content, including, but not limited to exhibition or asset descriptions and comments (collectively, "User Content"). You retain all intellectual property rights in and to any User Content that you post, upload or otherwise make available through the Services, including all applicable copyright rights. Metasteps does not claim any ownership, right, title or interest in your User Content. You are solely responsible for your User Content and for the consequences of publishing it. You represent and warrant that:
- you own or otherwise control all rights in the User Content you post, or have the legal right to use, display, distribute and reproduce such User Content and to grant the licenses described in these Terms
- the User Content you provide is accurate and not misleading; and
- the use and posting of your User Content does not violate these Terms of Service, infringe any third-party rights, or cause harm to any person or entity.
License to Metasteps
By uploading and/or posting any User Content to the Services, you grant Metasteps a worldwide, non-exclusive and royalty-free license, revocable upon removal of the User Content from the Services, to use the User Content (and the user name associated with it) solely as reasonably necessary to:
- provide and operate the Services, including displaying User Content on the Services;
- comply with your instructions pursuant to Metasteps' Data Protection Addendum;
- comply with applicable legal obligations, including responding to lawful requests from governmental authorities; and
- disclose User Content without compulsory legal process when Metasteps reasonably believes there is an imminent threat to life or physical safety.
Where permitted by law, Metasteps may refrain from notifying you of disclosures to governmental authorities if such notice would jeopardize an ongoing law enforcement investigation. Metasteps may engage third-party service providers to assist in carrying out its obligations and exercising its rights under these Terms of Service. Metasteps may also use short clips or screenshots of published exhibitions solely for the purpose of promoting and marketing the Services, without compensation to the curator.
However, Metasteps:
- will not use exhibitions for any other commercial purposes without your prior written consent; and
- will not use exhibitions that are not publicly available on the Internet.
License to other users
You also grant each user of the Services a limited, non-exclusive, non-transferable, personal and non-commercial license to access your User Content through the Site or other authorized access points and to use, reproduce, distribute, display and perform such User Content solely as permitted by the functionality of the Services and these Terms of Service. Unless designated as "unpublished", exhibitions are considered public information. User Content published in private mode and accessible only to specific users, User Content will be treated as private information.
Removal and Retention of User Content
The licenses granted by you to Metasteps and to the Metasteps Site users shall terminate within a commercially reasonable time, after you remove or delete your User Content. You acknowledge, however, that Metasteps may retain server copies of removed or deleted User Content for security and backup purposes only and not for display, distribution or performance. Metasteps has no obligation to remove User Content from third-party websites or other publicly accessible platforms where such content has been independently shared or indexed.
Content moderation and limits
Metasteps does not endorse any User Content or any opinions, recommendations, or advice expressed therein, and expressly disclaims all liability arising from User Content. Metasteps does not permit copyright infringement or violations of intellectual property rights on its Site, and will remove User Content if properly notified that such Content infringes third-party rights.
From time to time, Metasteps may impose limits on the amount of User Content stored through the Site and Services and reserves the right to remove User Content exceeding such limits. Accounts may also be terminated due to prolonged inactivity. If an account is terminated for any reason, associated User Content may be permanently deleted. While Metasteps will make reasonable efforts to notify you of such removal, you acknowledge that it is your sole responsibility to download and retain copies of any User Content you wish to preserve.
EU Users
If you are located in the European Union, your User Content may constitute personal data under the General Data Protection Regulation (GDPR). Please refer to our Data Processing Addendum for information about your rights, including access, rectification, and erasure.
For the avoidance of doubt, third-party AI service providers used to deliver the AI Features described in Section 12 (currently OpenAI, LLC) are not 'Third-Party Services' for the purposes of this section. They act as data sub-processors subject to contractual Data Processing Agreements and are governed by the terms of Section 12 and our Privacy Notice.
8. Third Party Services
Metasteps may make third-party content, products, or services available on or through the Services ("Third-Party Services"), whether as a convenience to users or because such content has been posted or made accessible by users (for example, links to third-party websites, software, or services).
When you access or use Third-Party Services, you acknowledge that these Terms of Service and other Metasteps policies no longer apply to your use of such third-party websites, services, or content.
The inclusion or availability of any Third-Party Services through the Services does not imply any affiliation with, endorsement of, approval of, or control by Metasteps. Metasteps makes no representations or warranties regarding, and accepts no responsibility for, the quality, accuracy, legality, ownership, or reliability of any Third-Party Services.
Your use of Third-Party Services is solely at your own risk and is subject to the applicable third-party terms, conditions, and privacy policies.
9. Advertisements and Promotions
The Services may include advertisements, promotions, or other content provided by third parties, including other users, Metasteps vendors, or third-party service providers.
Any interactions, transactions, or business dealings you have with third parties through the Services, and any associated terms, conditions, warranties, or representations, are solely between you and the applicable third party. Metasteps does not endorse, approve, or control any third-party products, services, advertisements, or promotions made available through the Services.
To the extent permitted by applicable law, Metasteps shall not be responsible or liable for any loss or damage arising from your interactions or dealings with third parties, or from the presence of third-party advertisements or promotions within the Services.
10. Metasteps Conduct Policy
You are solely responsible for the User Content that you submit, post, upload, or transmit through the Services whether publicly or privately. You agree not to use the Services to submit, post, or transmit any User Content that:
- is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another person's privacy, hateful, or otherwise objectionable;
- promotes violence, dehumanization, or propaganda targeting individuals, groups, or nations;
- infringes or violates any patent, trademark, trade secret, copyright, or other intellectual property or proprietary right of any third party;
- exploits, harms, or endangers minors in any way;
- impersonates any person or entity or falsely states or misrepresents your affiliation with a person or entity;
- constitutes unsolicited or unauthorized advertising, promotional materials, spam, junk mail, chain letters, pyramid schemes, or other forms of solicitation, except where expressly permitted by Metasteps;
- contains software viruses or other malicious code, files, or programs designed to interrupt, damage, or limit the functionality of any software, hardware, or telecommunications equipment;
- interferes with or disrupts the Services or negatively affects other users' ability to use or enjoy the Services; or
- collects, stores, or processes personal data of other users without a lawful basis or their consent,
- use the AI Features to generate, distribute, or facilitate any content or activity that violates this Conduct Policy
Violation of this Conduct Policy may result in the removal of User Content, suspension or termination of your account, or other actions as described in these Terms and applicable law.
11. User Content Disclaimer and Moderation
Metasteps does not actively pre-review User Content submitted, posted, or transmitted by users through the Services. User Content is the sole responsibility of the user who submits it.
Metasteps acts as a hosting service provider with respect to User Content and does not endorse, guarantee, or assume responsibility for the accuracy, integrity, completeness, legality, or quality of any User Content made available through the Services. You acknowledge that you may be exposed to User Content that is inaccurate, offensive, or otherwise objectionable.
To the extent permitted by applicable law, Metasteps shall not be liable for any loss or damage arising from User Content submitted by users, including errors or omissions in such content or reliance thereon.
Notwithstanding the foregoing, Metasteps reserves the right, but does not undertake an obligation, to monitor, review, restrict access to, or remove User Content where it reasonably determines that such content:
- violates these Terms of Service or applicable laws;
- infringes intellectual property, privacy, or other rights of a third party;
- is unlawful, abusive, defamatory, misleading, or obscene; or
- poses a risk to the safety, security, or integrity of the Services or users.
Nothing in this section limits any mandatory rights or obligations under applicable law, including consumer protection laws or the EU Digital Services Act.
12. AI-Powered Features
Metasteps integrates artificial intelligence ("AI") capabilities into our 3D studio and Support chat assistant (together, the "AI Features"). The AI Features are powered by large language models provided by third-party AI providers as described below.
You acknowledge that:
- The AI Features generate outputs based on statistical patterns in training data and are not infallible. Outputs may be inaccurate, incomplete, biased, or inappropriate for your specific circumstances.
- The AI Features do not constitute professional advice (legal, medical, financial, or otherwise) and should not be relied upon as such.
- We do not warrant that the AI Features will be error-free, uninterrupted, or fit for any particular purpose beyond the scope described in these Terms.
- You are solely responsible for reviewing, verifying, and exercising independent judgement before acting on any AI output.
- We accept no liability for any loss or damage arising from your reliance on AI-generated outputs without independent verification.
- AI outputs do not represent the views, opinions, or recommendations of Metasteps or its employees.
To provide the AI Features, we transmit certain data (including content you submit) to the following third-party AI service providers (each an "AI Provider"):
- OpenAI, LLC:
GPT-4 / ChatGPT API — 3180 18th Street, San Francisco, CA 94110, USA
Privacy Policy: openai.com/policies/privacy-policy
Usage Policy: openai.com/policies/usage-policies
Sub-processor list: openai.com/policies/subprocessors
We have entered into a Data Processing Agreement ("DPA") with OpenAI, which includes EU Standard Contractual Clauses (2021) for EEA data transfers. Further details are set out in our Privacy Notice.
When you use the AI Features, the content of your inputs (e.g. text you type, documents you upload, queries you submit) may be transmitted to the relevant AI Provider to generate a response. You should not submit any of the following categories of data via the AI Features:
- Special category personal data as defined under Article 9 GDPR (e.g. health data, biometric data, data revealing racial or ethnic origin, religious beliefs, sexual orientation, trade union membership, or criminal convictions).
- Financial account credentials, payment card numbers, or banking information.
- Passwords, authentication tokens, or security credentials.
- Personal data relating to children under the age of 16 (or the applicable age of digital consent in your member state).
- Confidential business information belonging to a third party that you are not authorised to share.
By default, AI Providers we work with do not use API inputs or outputs to train their AI models. Please refer to our Privacy Notice for details of applicable retention periods.
You agree not to use the AI Features to:
- Generate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
- Infringe any intellectual property rights, privacy rights, or other rights of any person.
- Circumvent, disable, or otherwise interfere with security-related features of the AI Features or attempt to reverse-engineer the underlying AI models.
- Attempt to extract, infer, or reproduce training data from any AI model.
- Generate spam, phishing content, or materials designed to deceive others.
- Violate OpenAI's Usage Policies (openai.com/policies/usage-policies).
Breach of this clause may result in suspension or termination of your access to the AI Features and/or your account, at our discretion.
You retain ownership of any content you input into the AI Features ("Input Content"). By submitting Input Content, you grant us (and our AI Providers, to the extent necessary to provide the AI Features) a limited, non-exclusive, worldwide licence to process the Input Content solely for the purpose of generating AI outputs in response to your request.
Ownership of AI-generated outputs ("Outputs") is subject to applicable law. AI-generated content may not be protected by copyright in all jurisdictions. You are responsible for ensuring that your use of any Output complies with applicable intellectual property laws. We make no warranties regarding the originality of Outputs or their freedom from third-party intellectual property claims.
We reserve the right to modify, suspend, or discontinue any AI Feature (or switch between AI Providers) at any time and without notice, where we reasonably consider it necessary to do so (for example, due to changes in an AI Provider's terms, regulatory requirements, or technical limitations). Where practicable, we will provide reasonable advance notice of material changes.
Metasteps also reserves the right, subject to obtaining any required consents and providing advance notice in accordance with our Privacy Notice, to use anonymised or aggregated data derived from your use of the AI Features to develop, train, or improve Metasteps' own AI systems and features. We will notify you before exercising this right and provide you with the opportunity to opt out.
13. Moodle Integration
13.1 Availability. The Moodle integration feature ("Moodle Integration") is available exclusively to Academic Plan users. It allows teachers and administrators to connect their institution's Moodle instance to Metasteps and import course content into their 3D spaces. The feature is not available for student access or and must not be used for that purpose.
13.2 API Token. To enable the Moodle Integration, you must provide a valid Moodle API token. By providing this token, you authorise Metasteps to access your institution's Moodle instance solely to retrieve and synchronise course content into your spaces. You are solely responsible for: (a) ensuring the token is scoped to the minimum permissions necessary; (b) using a dedicated API user rather than an administrative account where possible; and (c) revoking the token promptly if you disconnect the integration or no longer wish to grant access. Metasteps will not use the API token for any purpose other than operating the Moodle Integration.
13.3 Content Responsibility. You are solely responsible for the course content you import from Moodle. By importing content, you represent and warrant that: (a) you have the right and authority to import and display that content within Metasteps; (b) the content does not contain personal data beyond what is necessary for the intended educational use; (c) any personal data incidentally included in course materials is processed in accordance with applicable data protection law and your institution's own data governance policies, and (d) the content complies with all Metasteps’ usage terms and conduct policy as appear in the present document. Metasteps does not review or moderate content imported from Moodle and is not responsible for it.
13.4 Automatic Sync. Once connected, the integration automatically syncs changes to your Moodle course content. You can disconnect at any time via your integration settings, which will terminate Metasteps' access to your Moodle instance.
14. Termination and Modification of Metasteps Accounts
Metasteps may suspend or terminate your account or access to the Services, in whole or in part, if you violate these Terms of Service, misuse the Services, fail to maintain an active subscription where required, or where required by law. Metasteps may also suspend or discontinue the Services, or any part thereof, for legitimate business, technical, or legal reasons.
Where reasonably practicable, Metasteps will provide you with prior notice of termination or suspension. Metasteps may, however, suspend or terminate access immediately and without prior notice in cases of serious breach, security risk, fraud, or where required by law.
Upon termination, Metasteps may deactivate or delete your account and associated content in accordance with these Terms and applicable law. You are responsible for downloading and backing up any content you wish to retain prior to termination.
To the extent permitted by applicable law, Metasteps shall not be liable for any loss or damage arising from the suspension or termination of your access to the Services. Nothing in this section limits any mandatory rights you may have under applicable consumer protection laws.
15. Subscriptions and Access to Services
Access to Metasteps Services, including but not limited to publishing spaces, using pre-made spaces, adding built-in assets, and creating districts, requires an active subscription. Available subscription plans may differ in features, limits, and duration. To purchase a Subscription, you will be required to provide certain information to facilitate the transaction, including valid payment details such as a credit card number, billing address, and other necessary payment information (collectively, "Payment Information"). By submitting Payment Information, you represent and warrant that you are authorized to use the selected payment method and agree to pay all applicable fees in accordance with these Terms. All orders are processed by our authorized Merchant of Record, Stripe, Inc. ("Stripe"), accessible via Stripe.com. Stripe is solely responsible for handling all order-related inquiries, fulfillment, refunds, any related disputes, and the calculation, collection, and remittance of all applicable taxes, value-added tax (VAT), sales tax, duties, and other fiscal charges.
Your Subscription will commence on the date on which Metasteps provides you with access to the Services pursuant to its receipt of your valid Payment Information (the "Commencement Date") and will remain in effect for the duration of the Subscription term that you select at the time of your registration for the applicable Metasteps Plan (the "Subscription Term"). Subscription Fees are payable in advance either in full or in accordance with the billing frequency. Each Subscription Term will automatically renew for an additional period equal in length to the expiring Subscription Term unless either party provides written notice of non-renewal at least thirty (30) days prior to the end of the then-current Subscription Term.
You may cancel your Subscription Services at any time through the settings available in your Metasteps account. Upon cancellation of any Subscription Services: (i) no refunds will be issued for current subscription payments, unused subscription-allocated Plan Credits, or purchased Top-up Credits; (ii) automatic renewal will be disabled; (iii) you will retain access to the Services through the end of your current billing period (iv) Metasteps reserves the right, at its discretion, to permanently delete all data associated with the canceled subscription.
Except as otherwise expressly stated, all payments are non-refundable. No refunds are issued for partially used Services or service units. At its sole discretion, Metasteps may choose to provide a refund, discount, or other consideration. Any such accommodation provided in one instance does not create an obligation to provide the same or similar accommodation in the future.
All credits purchased or otherwise obtained in connection with the Services are non-transferable and may not be resold. All Credits are subject to expiration. For subscription accounts, plan credits expire at the end of the applicable billing cycle and do not roll over into subsequent Subscription Terms or billing periods. Top-up Credits also expire; however, unused top-up credits will roll over into subsequent Subscription Term.
In the event that any taxes, including but not limited to GST, VAT, sales tax or similar charges, are required to be collected under applicable local, state, provincial or foreign laws in connection with your subscription to the Services such Taxes will be charged to you through our payment processor. You agree to pay all applicable Taxes in addition to the subscription fees.
Metasteps may modify any and all fees or other pricing associated with the Services at any time by updating the Pricing Page or by providing other appropriate notice. Such modifications may include, without limitation: (i) Subscription Plan pricing and fees; (ii) Plan Credit pricing, allocation rates, and consumption costs; (iii) Top-up Credit pricing and purchase rates; (iv) credit-to-service action conversion rates and usage costs; (v) overage charges and penalty fees; (vi) feature access fees and premium service charges; and (vii) any other fees, costs, or pricing associated with the Services (collectively, "Service Fees").
Changes to subscription fees will apply to future billing periods and will be communicated at least thirty (30) days in advance where required by applicable law, including EU consumer protection law.
EU users: You have a statutory fourteen (14)-day right of withdrawal for digital services, unless you have expressly consented to the commencement of the Services during the withdrawal period and acknowledged that you thereby waive your right of withdrawal once the Services have begun.
16. Disclaimer of Warranties
The Site, the Services, the Metasteps materials, and any related products are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Metasteps disclaims all warranties of any kind, whether express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Metasteps does not warrant that the Services or any Metasteps materials will be uninterrupted, timely, secure, accurate, complete, reliable, current, or error-free, or that any defects will be corrected. Metasteps does not warrant that the Services will be free from harmful components.
Metasteps is not responsible for typographical errors or omissions relating to pricing, descriptions, text, images, or videos. Metasteps makes no warranty regarding the availability, reliability, or security of the Services and shall not be liable for any unauthorized access to, or modification, suspension, unavailability, or discontinuance of, the Services.
Nothing in this section shall affect any mandatory warranties or statutory rights that cannot be excluded under applicable law, including consumer protection laws.
17. Limitation of Liability
To the maximum extent permitted by applicable law, Metasteps and its directors, members, employees and agents shall not be liable for any indirect, incidental, special, consequential or exemplary damages, including, but not limited to, loss of use, loss of profits or loss of data, or business interruption, arising out of or relating to your use of or inability to use the Services, the Site, User Content, or any Metasteps materials, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if Metasteps has been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, the total aggregate liability of Metasteps for any and all claims arising out of or relating to the Services shall not exceed the total amount paid by you to Metasteps for the Services during the Subscription Term in which the claim arose.
Nothing in these Terms shall exclude or limit Metasteps' liability for death or personal injury caused by its negligence, for fraud or wilful misconduct, or for any liability that cannot be excluded or limited under applicable law, including mandatory consumer protection laws.
18. Indemnity
You agree to defend, indemnify and hold harmless Metasteps, its officers, directors and employees, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to reasonable attorney's fees) arising out of or related to:
- your access to or use of the Services,
- your violation of these Terms of Service,
- your violation of any third party right, including without limitation any intellectual property, property, or privacy right; or
- any claim that your User Submissions caused damage to a third party.
This indemnification obligation shall survive termination of these Terms of Service and your use of the Services.
19. Jurisdiction and Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Hellenic Republic (Greece), excluding its conflicts of laws principles. Subject to any mandatory provisions of applicable law, any dispute arising out of or relating to this Agreement or the Services shall be subject to the exclusive jurisdiction of the competent courts of Athens, Greece. This section does not affect any mandatory rights you may have under applicable consumer protection laws.
20. GDPR Compliance
Metasteps P.C. is established in Greece and processes personal data in accordance with Regulation (EU) 2016/679 ("GDPR") and Greek Law 4624/2019.
Metasteps acts as a controller in respect of personal data it processes for its own purposes, including account registration, order and invoicing records, usage data, and communications with you. Payment card data is processed directly by our payment provider as an independent controller. Metasteps acts as a processor in respect of personal data contained in content you upload to or create within the Services, where you or the entity you represent is the controller of that data.
Details of Metasteps' processing as controller, including purposes, legal bases, retention, international transfers, and your rights, are set out in the Privacy Notice. Processing carried out by Metasteps as a processor is governed by the Data Processing Addendum. In the event of any inconsistency, the Privacy Notice governs as to controller processing and the Data Processing Addendum governs as to processor processing.
Privacy enquiries may be sent to [email protected]. You have the right to lodge a complaint with a supervisory authority; Metasteps' lead authority is the Hellenic Data Protection Authority (www.dpa.gr).
